Cancellation by the Owner (Clause 9)
Transparency works both ways. If the Owner needs to cancel the charter, the terms protect you as the charterer:
- Force Majeure: If the Owner cancels due to force majeure (extraordinary, unforeseeable circumstances beyond anyone's control), all payments shall be refunded in full.
- Other Reasons: If the Owner cancels for any reason other than force majeure, you will receive a full refund of all monies paid plus liquidated damages equal to 25% of the Charter Fee (if notice is given 30 or more days before the charter start date). For cancellations with less notice, the damages scale increases to protect your interests.
