Cancellation After the Final Payment Is Due

If cancellation is notified after the date the final instalment has fallen due — whether or not it has actually been paid — the Owner is entitled to retain 100% of the Charter Fee. At this stage, the yacht has been fully prepared, crew assigned, provisions ordered, and the likelihood of securing a replacement charter is extremely low.

Committed Expenses (APA & Positioning)

If any Advance Provisioning Allowance (APA) or delivery/re-delivery fees have already been expended or committed for provisioning or positioning the vessel, those committed funds will be deducted from any refund that may be due.

  • Force Majeure: If the Owner cancels due to force majeure (extraordinary, unforeseeable circumstances beyond anyone's control), all payments shall be refunded in full.
  • Other Reasons: If the Owner cancels for any reason other than force majeure, you will receive a full refund of all monies paid plus liquidated damages equal to 25% of the Charter Fee (if notice is given 30 or more days before the charter start date). For cancellations with less notice, the damages scale increases to protect your interests.
